Anatomy of a Lawsuit - Ian Mair, B.A., LL.B
    So, you've been sued. Someone was injured on property where your firm was doing winter maintenance work. Now you're served with a Statement of Claim. What happens next? This presentation will explain the stages of a civil lawsuit, and what happens at each stage:
  • Pleadings;
  • Production of Documents;
  • Examination for Discovery;
  • Mediation and Pre-trial conferences; and,
  • Trial
We will discuss your insurer's role, the role of defence counsel, and your responsibilities in conducting the defence.
       
    Ian Mair is a lawyer who practices exclusively in the area of civil litigation. His firm, Moodie Mair Walker LLP, is a defence law firm based in Toronto, but the firm handles cases all across Ontario. Ian is frequently retained by insurance companies to defend complex personal injury cases; and, since 1988, when he was called to the Ontario Bar, he has handled thousands of these cases. Ian is an accomplished trial lawyer, who has tried many cases to verdict, before both judges and juries. He is often hired by other lawyers to appear in court on injury cases as their trial counsel.     Marie Clemens is a senior Associate at Moodie Mair Walker LLP. Marie holds a LL.B. from the University of Ottawa (2010) and a Honours B.A. in Lawand Psychology from Carleton University (2002). Since her call to the Ontario Bar in 2011, Marie has gained significant experience practising in the areas of insurance defence, professional liability and personal injury. She has appeared at the Ontario Superior Court of Justice, Small Claims Court, Financial Services Commission of Ontario and the License Appeal Tribunal. Marie is a member of The Advocates' Society; Executive Committee Member, Ontario Bar Association, Young Lawyers Division; Canadian Defence Lawyers; The Toronto Lawyers Association; and Team Leader of the Advocacy Club. Recent Court Decisions Involving Winter Maintenance Issues - Taylor Casement, B.A., J.D.
    Highlighting recent court decisions involving winter maintenance issues and how these decisions affect winter maintenance practices and policies.
       
    Taylor Casement is an associate with Moodie Mair Walker LLP practicing primarily in Insurance Defence. She received her B.A. from Illinois State University (attended on a full soccer scholarship) and J.D. from the University of Ottawa in 2011. Taylor was called to the Bar in 2012. She completed her articles in a large national law firm in Toronto. Taylor has made appearances before the Ontario Superior Court of Justice, Small Claims Court and various administrative tribunals. She sits on the Board of a charity called Stepstones for Youth, a charity that provides prevention programs for vulnerable youth aging out of the foster care system in Toronto. She is a member of the OBA, CBA, Young Women in Law and The Advocate's Society. On the Hot Seat: A Mock Examination for Discovery of a Snow Contractor (Track A/B)

    The Examination for Discovery is an important part of every lawsuit. Lawyers ask the key questions in the case, and if you are the defendant, you have to answer those questions. It is also an interaction with the legal system that landscaping contactors may encounter at some point in their careers. Our demonstration will begin with a mock preparation session between defence lawyer (played by Ian Mair) and snow contractor (played by Mark Humphries). This will be followed by a mock examination for discovery of the snow removal contractor by a plaintiff’s lawyer, played by Rob Kennaley. You will see first-hand the kinds of questions you will face if you are sued and you will take away some useful pointers on how to prepare for your examination. After the completion of the examination for discovery, there will be a panel discussion. And questions from you - the audience.

    Shortly after graduating from Centennial College, (Diploma in Ambulance Services), Mark Humphries completed the first Oshawa General Hospital paramedic training, and went on to represent Ontario successfully in International Emergency Care and Rescue competitions.
